the contract between you and us when you buy gear from this site.
These terms apply when you buy physical goods from whalestospace (“we”, “us”, “our”) via whalestospace.com (the “site”). They are governed by Irish law. Mandatory consumer protections in your country of residence may also apply and cannot be waived.

Descriptions, images, sizes, and prices are shown on each product page. Small variations in colour or finish can occur; nothing on the site is meant as a binding scientific or environmental claim about real-world outcomes.
who can buy
You must be able to form a legally binding contract in your jurisdiction. If you are under 18, you need permission from a parent or guardian to order.
how ordering works
- You add items to your cart and proceed to checkout. Checkout is hosted by Stripe; you will see the total price, shipping options (if offered), and taxes or duties where applicable before you pay.
- Your order is an offer to buy. We accept it when we (or our fulfilment partner) confirm shipment or when we expressly confirm acceptance by email. If we cannot fulfil your order, we will refund you.
- Payment is charged when you complete Stripe checkout, unless the checkout screen states otherwise.
price and currency
Prices are shown in euros (EUR) unless stated otherwise. We may change prices on the site at any time; the price that applies is the one shown at checkout when you place your order.
delivery
Delivery times and costs depend on your address and the options shown at checkout. Risk of loss passes to you when the goods are delivered to the address you provided. If a parcel is lost after handover to the carrier, contact us and we will help trace it; remedies depend on carrier terms and consumer law.
right of withdrawal (EU / UK consumers)
If you are a consumer in the European Union, the United Kingdom, or another jurisdiction that grants a statutory cooling-off period for distance sales, you generally have 14 days from the day you receive the goods to cancel your purchase for any reason, without giving a reason.
How to cancel: email sendthemupw2s@gmail.com with a clear statement that you wish to withdraw, your name, address, and order details. You may use the model withdrawal form below, but it is not mandatory.
Returning goods: after cancellation, you must return the goods to the address we provide, without undue delay and within 14 days of telling us you wish to withdraw. Unless we offered free return shipping, you pay return postage. Goods must be unused and in original condition with tags where applicable.
Refund: we refund all payments received from you, including outbound delivery (if you paid for standard delivery), within 14 days of receiving your withdrawal notice or proof of return, whichever is earlier. We may withhold refund until we receive the goods or proof you sent them. Refunds use the same payment method unless you agree otherwise.
Exceptions: the right of withdrawal may not apply to certain made-to-order or personalised items, or goods sealed for health or hygiene reasons once unsealed, as allowed by applicable law. If an exception applies, we will state it clearly before purchase.

faulty or not as described
Under Irish and EU consumer law you have rights if goods are faulty, not as described, or not of satisfactory quality. Contact us at sendthemupw2s@gmail.com with your order details and photos if helpful. We will repair, replace, reduce the price, or refund as applicable.
limitation of liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law. Subject to that, our total liability arising from your order is limited to the amount you paid for those goods, except where mandatory consumer law says otherwise.
disputes
We hope to resolve issues directly. EU consumers may use the EU online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged to use alternative dispute resolution but will consider good-faith requests.

changes to these terms
We may update these terms; the version on the site when you order applies to that order.
